Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and the operator of sqtr.app ("sqtr," "we," "us"). They govern your use of the sqtr website, Android app, and related services (the "Service"). By creating an account, listing a gym, booking a session, or otherwise using the Service, you agree to these Terms, the Privacy Policy, and the Membership Agreement.

If you do not agree, do not use sqtr.

1. What sqtr is

sqtr is an online marketplace that helps people find and book time at independent gyms — including home gyms, garage gyms, and small commercial spaces — and helps hosts list those spaces. sqtr is not a gym, landlord, or employer of hosts. Hosts are independent providers. A booking is a contract between the member and the host; sqtr provides the platform, payments, and related tools.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for keeping your password confidential. You may not impersonate another person or create an account for anyone other than yourself without permission.

3. Accounts

You may create a free pay-per-use account. Joining does not require a card. You agree to keep your contact information current so we can reach you about bookings, payments, and safety issues. We may suspend or close an account that we reasonably believe is fraudulent, abusive, underage, or in violation of these Terms.

4. Memberships, pay-per-use, and billing

Pay-per-use (current plan). There is no monthly fee. When you book a visit, you pay the visit price shown at checkout. Payment is authorized when you request the slot and captured only if the host confirms. If the host declines, or the authorization expires before confirmation, you are not charged.

Premium (not currently offered). Premium was a recurring monthly membership. It is not available for new purchase at this time. We may offer a monthly membership again; if we do, the price, included access, and billing terms will be shown before you subscribe. If you already have an active Premium membership, it continues under the terms in effect when you subscribed (or as we notify you of material changes) until you cancel. Those memberships auto-renew. Cancel anytime from your account; access continues through the paid period. Dues already paid are non-refundable except where required by law.

Payments are processed by Stripe. We do not store full card numbers. By paying, you authorize Stripe and sqtr to charge the selected payment method for visit fees, any membership you already have or later start, and any amounts you agree to at checkout.

5. Bookings

A booking request is an offer to train at the listed time. It is not confirmed until the host accepts. Hosts may decline requests. You agree to show up on time, follow the gym's rules and access instructions, treat the space and other people with respect, and leave the space as you found it.

Access instructions (including gate codes) are shown only after a booking is confirmed. You may not share those instructions with anyone else. Cancel from your account if you cannot attend. Confirmed visits that you cancel late, miss, or abuse may be charged and may affect your ability to book in the future.

6. Hosts and listings

If you list a gym, you represent that you have the legal right to offer that space, that your photos and description are accurate, and that the space is reasonably safe for the use you advertise. Listings are reviewed before they go public. We may refuse, take down, or edit a listing that is misleading, spam, unsafe, illegal, or outside sqtr's purpose.

You keep control of your hours and whether to confirm a request. You are responsible for your equipment, premises, insurance, local permits, and any taxes on your earnings. sqtr does not provide liability insurance for hosts or members unless we expressly say so in writing.

7. Host payouts

Host earnings are paid through Stripe Connect to a bank account the host connects. During the Brevard County beta (through December 1, 2026) sqtr charges no platform fee — hosts keep 100% of the visit price. After the beta, sqtr will charge 15% (minimum 50¢) unless we notify you of a different rate. You may list a gym and accept bookings before connecting a bank; those earnings are held until payouts are connected. Stripe's processing fees are handled according to Stripe's terms. Payout timing follows Stripe's schedule after a booking is confirmed and the member's payment is captured. You must complete Stripe identity verification to receive payouts.

8. Assumption of risk and release

Physical exercise and the use of gym equipment — including equipment in private homes and garages — carry a risk of injury, death, or property damage. You participate voluntarily and at your own risk. To the fullest extent permitted by law, you release and hold harmless sqtr, its owners, and affiliates from claims arising out of your use of the Service or any listed gym, except to the extent caused by sqtr's gross negligence or willful misconduct.

Hosts are not sqtr employees. sqtr does not inspect every space. You are responsible for evaluating whether a gym is suitable for you.

9. Acceptable use

You agree not to:

  • Use sqtr for anything illegal, including unlicensed lodging or prohibited businesses
  • Harass, threaten, or discriminate against hosts, members, or staff
  • Post spam, scams, fake gyms, or stock photos of a space you do not control
  • Scrape, overload, or reverse engineer the Service
  • Bypass booking or payment (for example, taking a listing off-platform to avoid fees after discovering a host through sqtr, for 24 months)

10. Content

You grant sqtr a non-exclusive, worldwide license to host and display the content you upload (photos, descriptions, reviews, profile information) for operating and promoting the Service. You represent you have the rights to that content. We may remove content that violates these Terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, SQTR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that a gym will be available, that a host will confirm, or that the Service will be uninterrupted or error-free.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SQTR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO SQTR IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100. SQTR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. Some states do not allow certain limitations; in those states, our liability is limited to the maximum extent permitted.

13. Indemnity

You will indemnify and hold sqtr harmless from claims, damages, and reasonable legal fees arising out of your content, your gym, your conduct at a listed gym, or your violation of these Terms, except to the extent caused by sqtr's gross negligence or willful misconduct.

14. Changes

We may update these Terms. The "Last updated" date will change. Material changes will be noted on the Service or by email. Continued use after the effective date constitutes acceptance. If you do not agree, stop using sqtr and cancel any membership.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Courts located in Florida shall have exclusive jurisdiction, except that sqtr may seek injunctive relief in any jurisdiction to protect the Service.
